These Terms of Use (the “Terms”) are an agreement between you and Foxus Visuals governing your access to foxusvisuals.com and Foxus services. By creating an account or using the services, you agree to these Terms and acknowledge the Privacy Policy and Cookie Policy.
1. Eligibility and accounts
You must provide accurate information, safeguard your password, and promptly update your account details. You are responsible for activity under your account. You may not impersonate another person or business, create deceptive accounts, automate abusive registrations, or use the services unlawfully. Users under 18 may use the services only with permission and supervision of a parent or legal guardian.
2. Foxus services
Foxus may provide creative services, bookings, trials, subscriptions, invoices, electronic signatures, public business profiles, reviews, networking connections, private messages, communities, events, boards, comments, files, and other account tools. Features may be changed, suspended, or discontinued when reasonably necessary.
3. Public profiles and community content
You retain ownership of content you submit. You grant Foxus a nonexclusive, worldwide, royalty-free license to host, reproduce, resize, display, and distribute that content only as needed to operate, promote, secure, and improve the Foxus platform. Public-profile, review, community, event, board, and comment content may be visible to the public. Do not publish confidential information you are not authorized to disclose.
4. Community standards
You may not post illegal, fraudulent, threatening, harassing, hateful, sexually exploitative, infringing, malicious, deceptive, or spam content; manipulate reviews; scrape member data; distribute malware; interfere with security; or use private messages for unsolicited bulk promotion. Reviews must reflect genuine experiences. Community and event owners are responsible for their boards and joining decisions, but Foxus administrators may moderate any area.
5. Moderation and enforcement
Foxus may investigate reports and remove content, limit features, suspend accounts, preserve evidence, or terminate access when reasonably believed necessary to protect users, enforce these Terms, comply with law, or maintain service integrity. We may correct clear errors and respond to valid intellectual-property or legal requests.
6. Bookings, purchases, subscriptions, and trials
Prices, deliverables, schedules, renewal terms, cancellation rules, and refund terms shown at checkout, in a proposal, invoice, booking, subscription, or signed service agreement become part of these Terms. Payment is due as stated. Each eligible business may use the Foxus Trial only once. Trial availability is limited, eligibility may be reviewed, and any disclosed community booking fee, cancellation condition, or charitable contribution condition applies.
7. Intellectual property
Foxus branding, site design, software, templates, and original service materials are owned by Foxus or its licensors. Except for rights expressly granted in a signed agreement, you may not copy, resell, reverse engineer, or commercially exploit them. Your separate project agreement controls ownership and licensing of commissioned deliverables.
8. Third-party services
Payments, bookings, electronic signatures, email, hosting, and embedded content may rely on third-party providers. Their terms and privacy notices may apply. Foxus is not responsible for independent third-party services outside its reasonable control.
9. Disclaimers and limitation
To the maximum extent permitted by law, online and community features are provided “as is” and “as available.” Foxus does not guarantee uninterrupted availability, business results, member statements, event attendance, employment, or transactions between users. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded. To the maximum extent permitted by law, Foxus is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the platform.
10. Indemnity
To the extent permitted by law, you agree to defend and indemnify Foxus from third-party claims caused by your unlawful conduct, your content, your infringement of another person’s rights, or your material breach of these Terms.
11. Governing law and changes
These Terms are governed by applicable United States and Florida law, without overriding mandatory consumer protections that apply where you reside. Material updates will be posted with a revised effective date and, when appropriate, additional notice or renewed acceptance.
